VisitWise provides an AI-powered customer retention platform that helps businesses engage with their customers through personalized interactions. Our services include but are not limited to customer analytics, automated engagement, and retention strategy tools.

User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Subscription and Payments

Some aspects of the Service may be provided for a fee. You will be required to select a payment plan and provide accurate information regarding your payment method.

By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating payment. The subscription fee will be billed on a recurring basis according to the payment plan you select. We reserve the right to change our pricing at any time, and we will notify you of any changes before they take effect.

You may cancel your subscription at any time, but no refunds will be provided for any unused portion of the current billing period.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of VisitWise.

User Content

You retain all rights to any content you submit, post, or display on or through the Service. By submitting, posting, or displaying content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

You represent and warrant that you own or have the necessary rights to the content you provide and that the content does not infringe the intellectual property rights or other rights of any third party.

Prohibited Uses

You agree not to use the Service:

• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation

• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which may harm VisitWise or users of the Service

Limitation of Liability

In no event shall VisitWise, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
